PART I — INTRODUCTION, SERVICES AND USER OBLIGATIONS
1. Definitions and Acceptance
These Terms & Conditions (“Terms”) govern the access to and use of the challan payment, clearance, settlement, contestation, facilitation and related services (“Services”) provided by Rosmerta Digital Services Limited (“RDSL”, “Company”, “We”, “Us” or “Our”) through its website, mobile application, digital platform, API, customer support channels and/or other authorized channels (collectively, the “Platform”).
“You”, “Your” or “User” means any individual, company, entity, fleet operator, vehicle owner, driver, authorized representative or other legal person accessing or using the Services.
By accessing the Platform, submitting a challan for processing, making a payment or otherwise availing the Services, You acknowledge that You have read, understood and agreed to these Terms.
If You are using the Services on behalf of another individual or entity, You represent and warrant that You are duly authorized to do so and to bind such individual or entity to these Terms.
If You do not agree with these Terms, You must not use or continue using the Services.
2. Scope of Services
RDSL provides technology-enabled facilitation and processing services for challan-related matters, which may include:
• Retrieval and verification support for challan details; • Online challan payment; ◦ Facilitating access to independent legal professionals, where legal representation or assistance is required. Facilitation of challan contestation through independent legal professionals, where available. • Coordination with authorized legal professionals, service providers and other third parties; • Payment processing and technical support; • Status tracking and customer notifications; • Issuance or sharing of payment receipts, acknowledgements, declarations or government-portal evidence, where applicable; and • Other related services made available by RDSL from time to time.
The exact scope of Services available for a particular challan shall depend upon the nature of the challan, applicable government processes, jurisdiction, eligibility criteria, documents, OTPs, authorizations and other requirements.
RDSL may modify, suspend, discontinue, improve or introduce Services or features from time to time.
3. Facilitation and Legal Services
RDSL primarily acts as a technology and service facilitation platform for challan-related processing. RDSL undertakes to provide the selected facilitation Service; it does not undertake or guarantee a particular judicial or governmental outcome.
Unless expressly stated otherwise for a particular Service: • Nothing on the Platform shall be construed as legal advice. • Use of the Platform does not by itself create an attorney-client relationship between RDSL and the User. • Where legal assistance or representation is required, RDSL may engage or facilitate access to independent third-party legal professionals or other authorized service providers. • Such professionals/service providers may act independently and may be subject to applicable professional, judicial and regulatory requirements. • Where representation before a court or authority is required, the User may be required to execute a vakalatnama, authorization, undertaking or other documents required by the relevant court or authority. • Where the relevant Judicial authority requires the User’s personal appearance, the Service Provider may not be able to complete the Service on the User’s behalf.
Where a Service specifically includes legal facilitation, the scope shall be limited to the service expressly purchased by the User.
4. Challan Information and Government Data
Challan information displayed or processed through the Platform may be obtained from government websites, government databases, government-provided APIs, authorized data sources or other third-party systems.
RDSL does not independently create, alter or guarantee the accuracy of challan information originating from government or third-party systems.
Accordingly: • Challan amount, status, offence details, vehicle details, court status and other information may be subject to change or correction by the relevant authority. • RDSL shall not be responsible for discrepancies, inaccuracies, omissions or delays originating from government systems or other external sources. • Online and court challan classification may depend upon information received from government systems. • Non-updation of government records shall not automatically constitute failure of the Services.
The User should independently verify critical information where necessary.
5. User Information and Authorization
The User represents and warrants that all information, vehicle particulars, challan details, documents, identity information, contact information and other information submitted to RDSL are: • True; • Accurate; • Complete; • Current; • Not misleading; and • Submitted by a person duly authorized to provide such information.
RDSL may rely upon information and documents supplied by the User without independently verifying every such detail.
The User shall be solely responsible for any loss, rejection, delay, non-compliance or other consequence arising from inaccurate, incomplete, outdated, fraudulent or misleading information or documents.
If RDSL reasonably determines that the information or documents supplied are insufficient, inaccurate, suspicious or inconsistent, RDSL may suspend, reject or discontinue the relevant Service.
6. Documents and OTP
Certain challan retrieval, payment, settlement or court-related processes may require documents, authorizations, mobile-number verification, OTPs or other authentication.
The User agrees to provide such information, documents and authentication when required.
The User acknowledges that: • OTPs may be sent to the mobile number registered with the relevant RTO/government authority; • Delay or failure in providing an OTP or required authentication may delay or prevent processing; • Documents must correspond with the relevant vehicle/challan/person; • Any rejection arising from document discrepancies may be the User’s responsibility; and • RDSL shall not be responsible for delays caused by failure, refusal or delay by the User in providing required information, OTPs, documents or authorization.
The User authorizes RDSL and its authorized Service Network to use such information solely for providing the requested Services, subject to applicable law. The User must not disclose banking, UPI or payment authentication OTPs to RDSL personnel.
7. Service Network and Third-Party Providers
“Service Network” means independent legal professionals, payment service providers, technology providers, authorised vendors and other third parties engaged or facilitated by RDSL for delivery of the Services.
RDSL may engage or work with third parties including: • Payment gateways; • Banks and financial institutions; • Government databases and technology providers; • Legal professionals; • Courts and authorized representatives; • Service vendors; • Technology and API providers; • Customer support providers; and • Other Service Network members required for delivery of the Services.
The User authorizes RDSL to share necessary information and documents with such Service Network where required to fulfil the requested Service.
RDSL may not be responsible for independent acts, omissions, delays, failures, errors or decisions of third parties where such matters are beyond RDSL’s reasonable control.
PART II — FEES, PAYMENT, CANCELLATION AND REFUNDS
8. Fees and Charges
The User agrees to pay all applicable: • Challan/penalty amounts; • Convenience fees which represents consideration payable for technology, processing, facilitation and coordination.; • Third Party charges which may include Legal professional, payment gateway or other third-party charges, if separately applicable. • Applicable taxes; and • Any other charges disclosed to the User before or during the transaction.
All applicable charges shall be displayed or communicated to the User before payment, wherever practicable.
RDSL may determine or revise its service, convenience or platform fees from time to time, subject to applicable law and applicable notice requirements.
Unless expressly stated otherwise, service/convenience/platform fees are consideration for the Services and are separate from the statutory challan/penalty amount payable to the relevant authority.
9. Payment
Where applicable, payment for the selected Service shall be made upfront before processing begins.
The User is responsible for ensuring that: • Correct payment details are provided; • The correct challan is selected; • The correct vehicle/challan information is submitted; and • Sufficient funds are available for the transaction.
RDSL shall not be responsible for delays, failures, reversals, errors or discrepancies caused by banks, payment gateways, card networks, financial institutions or other payment intermediaries.
Where a payment is unsuccessful or a transaction is not completed, the User may be required to contact the relevant payment provider or RDSL support channel for resolution.
User authorises RDSL to pay the Lawyer and the Government Challan Fee on their behalf as per their authorization to collect & pay, in terms of Rule 33 of the CGST Rules, 2017.
10. Agreed Consideration for Service
The User pays an agreed consolidated consideration for the selected Service. The Convenience Charge is consideration for RDSL's technology, facilitation, coordination, processing and Service Network and is independent of the final amount accepted or determined by the competent authority.
The User acknowledges that the actual penalty, fine, compounding amount or settlement amount finally imposed, accepted or determined by a competent authority may differ from the original challan amount or the amount estimated at the time of initiating the Service.
Any reduction in the statutory challan/settlement amount shall not, by itself, entitle the User to claim any refund or adjustment of the consolidated consideration paid by the User.
Where specifically disclosed as part of the selected Service or commercial terms, any difference between the amount paid by the User and the amount ultimately accepted or payable to the relevant authority may be retained by RDSL as consideration for the Services, and the User shall not be automatically entitled to a refund, rebate, credit or adjustment of such difference except where expressly provided by RDSL or required by applicable law.
11. Cancellation
Once processing of a challan has commenced, cancellation may not be permitted except where expressly provided under the applicable Service terms.
Where RDSL provides a cancellation window for a particular Service, the request must be raised within the specified period and through the designated support channel or transaction/ticket reference.
Cancellation shall not be available after the challan resolution application, payment or representation has reached a stage where processing has materially commenced, except where expressly provided or required by applicable law.
12. Refund Policy
Refunds shall be governed by the specific refund conditions applicable to the Service selected by the User.
A refund may be considered, subject to evaluation, where: • RDSL is unable to provide the purchased Service for reasons directly attributable to RDSL; • The transaction is rejected or cannot be processed under circumstances for which a refund is expressly provided; • A payment has been successfully debited but the relevant Service was not delivered, subject to verification; or • Any other refund circumstance expressly communicated by RDSL applies.
No refund shall be payable merely because: • The User changes their mind after processing has commenced; • The User independently chooses to use another service provider after submitting the challan to RDSL; • A court or authority passes an adverse order; • A government portal is unavailable; • A court, Lok Adalat or authority delays processing; • The User fails to provide required documents/OTP/authorization; or • The User supplied incorrect or incomplete information,
except where otherwise expressly stated or required by applicable law.
Refund requests must be raised within the applicable period specified by RDSL.
The User may be required to provide the transaction/order/ticket ID and supporting information for processing the refund.
Any approved refund shall ordinarily be credited to the original payment method, subject to the processing timelines of the relevant payment gateway or financial institution.
RDSL shall not be responsible for delays occurring at the bank, payment gateway or financial institution after initiation of the refund.
PART III — PROCESSING AND SERVICE DELIVERY
13. Turnaround Time (TAT)
Any turnaround time (“TAT”) communicated by RDSL is an estimated or indicative timeline unless expressly stated otherwise.
TAT shall generally be calculated only after RDSL has received all information, documents, payments, OTPs, authorizations and other requirements necessary to process the relevant challan.
Actual timelines may vary because of: • Government portal availability; • Government processing; • Court schedules; • Court holidays; • Court or lawyer strikes; • Lok Adalat schedules; • Government or judicial authority directions; • Document discrepancies; • OTP/authentication delays; • Legal or procedural complexities; • Payment gateway/banking issues; • Third-party dependencies; • Force majeure events; and • Other circumstances outside RDSL’s reasonable control.
RDSL does not guarantee that every challan will be settled within an indicative TAT.
14. Indicative State-wise Court Challan TAT
RDSL does not promise any guaranteed timeline for closure of the case, however following indicative timelines are expected, based of precedence, in respect of case closure:
Online Challan – 3-5 working days Virtual court challans – 3-5 working days Physical court challans – 30-45 working days for all states except Maharashtra where timelines are 75-90 working days.
These timelines are indicative only and may vary due to court availability, traffic authority processing, government portal functionality, strikes, holidays, Lok Adalat schedules, document discrepancies and other factors beyond RDSL’s reasonable control.
15. Government Portal Status Updates
The final settlement/payment status may take additional time to reflect on the relevant government or traffic department portal even after payment or settlement has been completed.
RDSL shall not be responsible for delays in government-system updation.
Where a receipt is unavailable, RDSL may, where available, provide an acknowledgement, declaration, screenshot or other evidence obtained from the relevant government system as evidence of the transaction or status available to RDSL.
16. Lok Adalat and Court Processing
Lok Adalat and court-related challans may be subject to token systems, court availability, scheduling, jurisdictional requirements and other procedural restrictions.
Successful processing through a particular Lok Adalat or court session cannot be guaranteed. Where the challan is available through an alternative authorized government mechanism, RDSL may use such mechanism where feasible.
The final outcome of any proceeding, including any order, direction, penalty, rejection or other action, remains subject to the discretion and authority of the relevant court or government authority.
17. Personal Appearance
Certain challans may require the User’s personal appearance before a court or authority.
Where personal appearance is mandatory and cannot legally or procedurally be completed through RDSL or its Service Network: • RDSL may decline or discontinue processing; • The User shall be responsible for complying with the relevant appearance requirement; and • Any delay or inability to settle the challan arising solely from such requirement shall not be treated as a failure by RDSL.
18. Challan Rejection or Non-Processing
RDSL shall not be responsible for rejection, non-processing or adverse action by a traffic department, court, Lok Adalat or government authority.
Where a refund is applicable following such rejection, it shall be governed by the applicable refund policy.
The User shall be responsible for rejection caused by: • Incorrect documents; • Inconsistent vehicle/person details; • Incorrect challan information; • Expired or invalid documents; • Missing authorization; • Failure to provide OTP/authentication; or • Any other information or action attributable to the User.
PART IV — USER COMMUNICATIONS, DATA AND PLATFORM USE
19. Communications and Marketing
By using the Services, the User may receive service-related communications including: • Transaction updates; • Challan status notifications; • Payment confirmations; • Document/OTP requests; • Support communications; and • Other communications necessary for delivery of the Services.
Where permitted by applicable law and subject to applicable consent requirements, RDSL may also send promotional or marketing communications.
Users may opt out of promotional communications through the mechanism provided by RDSL.
20. Data Protection and Privacy
RDSL may collect and process information necessary to provide the Services, including: • Name; • Mobile number; • Email address; • Vehicle registration details; • Challan details; • Identity documents; • Vehicle documents; • Payment and transaction information; • OTPs and authentication information, where applicable; and • Other information reasonably required to provide the Services.
Such information may be shared with authorized Service Network members, payment gateways, government authorities, legal professionals and other service providers strictly to the extent necessary for providing the Services and subject to applicable law.
RDSL shall process personal data in accordance with its Privacy Policy and applicable data-protection laws, including the Digital Personal Data Protection Act, 2023, to the extent applicable. Personal data may be retained for as long as necessary for the purposes for which it was collected or as required under applicable law.
Where applicable, Users may exercise rights available to them under applicable data-protection laws through the designated grievance/privacy channel.
21. Prohibited Use
The User shall not use the Platform or Services: • For any unlawful, fraudulent or unauthorized purpose; • To provide false or misleading information; • To impersonate another person or entity; • To interfere with the Platform or its security; • To attempt unauthorized access to systems or data; • To use automated requests without authorization; • To misuse payment systems; • In a manner that creates unreasonable liability or risk for RDSL or third parties; • To violate any applicable law, regulation, court direction or government requirement; or • In any manner that may harm RDSL, its Service Network, other Users or third parties.
RDSL may suspend or refuse Services where it reasonably suspects fraud, abuse, illegal activity or violation of these Terms.
22. Suspension and Termination
RDSL may suspend, restrict or terminate access to the Platform or Services where: • The User breaches these Terms; • The User provides false, fraudulent or misleading information; • Fraudulent or unlawful activity is suspected; • The User misuses the Platform; • Required information or documents are not provided; • Continuing the Service may expose RDSL to legal, regulatory or operational risk; or • The Service is discontinued.
Where permitted by law, RDSL may take such action without prior notice where immediate action is reasonably necessary.
Termination shall not affect rights or obligations that by their nature are intended to survive termination.
23. Promotions, Discounts and Rewards
RDSL may, at its discretion, introduce promotional offers, discounts, credits, rewards, referral benefits or loyalty programs.
Unless expressly stated otherwise: • Promotions are subject to their specific terms; • Promotions are discretionary and may be modified, suspended or withdrawn; • Promotional benefits do not create a permanent contractual entitlement; and • RDSL may impose eligibility conditions, limits or expiry dates.
24. Intellectual Property
All rights, title and interest in the Platform, software, technology, content, designs, logos, trademarks, service marks, graphics, text, databases, processes and other materials provided by RDSL belong to RDSL or its respective licensors.
Except as expressly permitted: • Users may not copy, reproduce, modify, distribute or commercially exploit RDSL’s content; • Users may not use RDSL’s trademarks or logos without prior written authorization; • Users may not reverse engineer, decompile or attempt to derive source code from the Platform; and • Users may not use automated systems, bots, crawlers or similar mechanisms to access the Platform unless expressly authorized.
25. User Content and Feedback
Any feedback, suggestions, ideas, comments or other submissions voluntarily provided by a User may be used by RDSL for improving its products and Services, subject to applicable law and the RDSL Privacy Policy.
The User represents that any content submitted does not infringe the rights of any third party and is not unlawful, fraudulent, defamatory or misleading.
26. Third-Party Links and Services
The Platform may contain links, references, integrations or access to third-party websites, applications, payment systems or services.
Such third-party services are not necessarily controlled or endorsed by RDSL.
Users access third-party services at their own risk and must comply with the applicable terms and privacy policies of such third parties.
RDSL shall not be responsible for third-party content, errors, omissions, interruptions, security practices or services beyond RDSL’s reasonable control
PART V — DISCLAIMERS, LIABILITY AND RISK ALLOCATION
27. As-Is Basis and No Guarantee
The Platform and Services are provided on an “as-is” and “as-available” basis to the extent permitted by applicable law.
RDSL does not warrant that: • The Platform will always be available; • Government data will always be accurate or current; • Every challan can be settled; • A particular court or authority will accept a particular request; • A challan will be resolved within a particular period; or • A particular legal, financial or regulatory outcome will be achieved.
No statement, representation or warranty other than those expressly contained in these Terms shall be binding upon RDSL.
28. Limitation of Liability
To the fullest extent permitted by applicable law, RDSL shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive loss or damage, including loss of profits, business, revenue, goodwill or opportunity.
RDSL shall not be liable for losses arising from or connected with: • Decisions or orders of courts, Lok Adalats or government authorities; • Government portal outages or errors; • Government data inaccuracies; • Banking or payment-gateway failures; • Third-party Service Network acts or omissions beyond RDSL’s reasonable control; • Court closures, holidays or strikes; • Lawyer/service-provider delays; • User-provided inaccurate or incomplete information; • Delays in government portal updation; • Rejection by a government authority; • Failure to provide OTPs, documents or authorization; • Force majeure events; or • Any other event outside RDSL’s reasonable control.
RDSL's aggregate liability relating to a particular transaction shall, to the maximum extent permitted by law, not exceed the Convenience Fee actually received by RDSL for that transaction. Nothing in these Terms shall exclude or limit liability that cannot legally be excluded or limited under applicable law.
29. Indemnification
The User agrees to indemnify, defend and hold harmless RDSL, its affiliates, directors, officers, employees, agents, representatives, Service Network members and partners from claims, losses, liabilities, damages, penalties, costs and expenses arising from or relating to: • Breach of these Terms; • Inaccurate, incomplete, false or misleading information supplied by the User; • Fraudulent, unlawful or unauthorized use of the Platform; • Misuse of the Services; • Violation of applicable law; • Claims arising from documents or content submitted by the User; • Third-party claims relating to the User’s vehicle, challan or personal information; or • Any act or omission of the User causing loss or damage to RDSL or any third party.
This obligation shall survive termination of the Services to the extent permitted by applicable law.
30. Force Majeure
RDSL shall not be responsible for delay, interruption or failure to perform Services caused by circumstances beyond its reasonable control, including: • Government actions or restrictions; • Court orders or procedural changes; • Government portal/system failures; • Internet or telecommunications failures; • Payment-system failures; • Natural disasters; • Fire, flood or other physical events; • Strikes or labour disruptions; • Court or lawyer strikes; • Civil disturbance; • Cyber incidents beyond reasonable control; or • Any other force majeure event.
Any applicable TAT shall automatically be extended for the duration reasonably required to address such event.
PART VI — GRIEVANCE AND GENERAL LEGAL TERMS
31. Complaints and Grievances
Users may raise complaints or grievances through:

RDSL shall acknowledge and endeavour to resolve complaints within the timelines prescribed under applicable law and its applicable grievance-redressal policy.
The User should retain the relevant order ID, transaction ID, challan number and supporting documents when raising a complaint.
32. Modification of Terms
RDSL may amend, update or modify these Terms from time to time.
Updated Terms shall become effective upon publication on the Platform or communication to the User, as applicable.
Continued use of the Services after the effective date of revised Terms shall constitute acceptance of the revised Terms, subject to applicable law.
If the User does not agree to the revised Terms, the User must discontinue use of the Services.
33. Assignment
RDSL may assign, transfer, subcontract or delegate any of its rights or obligations under these Terms to an affiliate, successor, service provider or other entity, subject to applicable law.
The User may not assign or transfer rights or obligations under these Terms without RDSL’s prior written consent.
34. Waiver
Failure or delay by RDSL in exercising any right or remedy under these Terms shall not constitute a waiver of that right or remedy.
Any waiver shall be effective only to the extent expressly provided by RDSL.
35. Severability
If any provision of these Terms is determined to be invalid, illegal or unenforceable by a competent authority, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
36. Entire Agreement
These Terms, together with the applicable Privacy Policy, Service-specific terms, payment/refund policies and other policies expressly incorporated by reference, constitute the entire agreement between the User and RDSL concerning the relevant Services and supersede prior communications or understandings relating to the same subject matter.
37. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India.
Subject to applicable law and any mandatory dispute-resolution requirements, disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts at New Delhi, India.
Nothing in this clause shall restrict RDSL from seeking urgent interim, injunctive or other appropriate relief from a competent court where permitted by law.
38. Acknowledgement
By clicking “I Agree”, making payment or submitting a challan for processing, user confirms that he/ she has read and accepted these Terms, understood the applicable Fees and Service conditions, and authorised RDSL to process the information required for providing the selected Service.
